Terms of Use

1. Agreement to Terms

By accessing or using our mobile application, Medusa AI Generator (“the App”), you agree to be bound by these Terms of Use (“Terms”). If you disagree with any part of the terms, then you may not access the App. These Terms apply to all visitors, users, and others who access or use the App.

2. AI-Generated Content and Intellectual Property

Your Content: You retain ownership of the text prompts you provide to the App.

AI Generations: The artificial intelligence (“AI”) generates new images (“Generations”) based on your prompts. The ownership of AI-generated art is a complex and evolving area of law. We grant you all rights to the Generations that are permissible under current law.

Commercial Use: If you are subscribed to a paid plan (e.g., Stone Access, Serpent Creator, Medusa Immortal), you are granted a worldwide, royalty-free, perpetual license to use your Generations for any purpose, including commercial purposes. Free users are granted a license for personal, non-commercial use only.

License to Us: By using the App, you grant Serpentyne Labs, LLC a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your public Generations for the purposes of operating, improving, and marketing our services. We will never use your private Generations without your explicit permission.

3. User Responsibilities and Prohibited Content

You are solely responsible for your use of the App and for any content you generate. You agree not to use the App to create or disseminate any content that is:

  • Illegal, harmful, fraudulent, or for any unlawful purpose.
  • Explicitly sexual, pornographic, or depicts non-consensual sexual content (NSFW). Our AI filters automatically block such Generations.
  • Hateful, defamatory, discriminatory, or harassing towards any individual or group.
  • Violent, graphic, or promotes self-harm.
  • Infringing on any third party’s intellectual property rights, including copyrights and trademarks. Do not use prompts that describe copyrighted characters or brands you do not have rights to.
  • Intended to create misinformation or “fake news”.
  • In violation of personal privacy, such as creating images of private individuals without their consent.

Violation of these rules may result in content removal, feature limitations, or permanent account suspension.

4. Subscriptions, Renewals, and Cancellations

Billing: Subscriptions are managed exclusively through the Apple App Store and Google Play Store. All plans are billed on a recurring weekly basis.

Renewal: Your subscription will automatically renew each week unless you cancel it at least 24 hours before the end of the current billing period.

Cancellation: You may cancel your subscription at any time through your account settings in the App Store or Google Play Store. Your access to premium features will continue until the end of the current billing period.

5. Refund Policy

All payments are handled by the respective app stores (Apple App Store or Google Play Store). As such, we do not have the ability to process refunds directly. Any refund requests must be made through the platform where you purchased the subscription, subject to their terms and conditions.

6. AI Generation Disclaimer

The Generations are created by an AI system. While we strive for accuracy and quality, the output may sometimes be unpredictable, inaccurate, or may not meet your expectations. The AI may produce artifacts or details that do not perfectly align with your prompt. We are not liable for any discrepancies between the prompt and the final Generation.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
